EU Safety Compliance

Navigating EN 71 directives for a US toy importer entering the European market

The Challenge

A US-based toy importer had been selling successfully on Amazon US for 3 years. When they attempted to expand into Amazon EU (Germany, France, UK), their existing products were flagged for non-compliance with EU Toy Safety Directive 2009/48/EC. Key gaps included chemical composition testing (EN 71-3), mechanical safety (EN 71-1), and missing CE marking documentation. Without resolution, their EU listings would be suspended.

Our Approach

Step 1: Compliance Gap Analysis

We reviewed the client's full product catalog (23 SKUs) against EN 71 Parts 1-3 requirements. We identified 8 SKUs with material composition risks (phthalate content, heavy metals in paint), 5 SKUs with mechanical hazards (small parts for under-3 labeling), and all 23 missing Technical Documentation files required for CE marking.

Step 2: Factory Coordination

Working directly with the Shantou factories, we coordinated material substitutions (switching to phthalate-free PVC and EN 71-3 compliant paints), redesigned packaging with correct age-grade warnings, and established a testing protocol with an accredited EU Notified Body lab (TUV Rheinland Shenzhen).

Step 3: Testing & Certification

We managed the end-to-end testing process: sample collection, lab submission, result review, and re-testing for 3 SKUs that initially failed flammability requirements. Total testing cycle completed in 6 weeks including re-tests.

Step 4: Documentation & Compliance File

We compiled the Technical Documentation package for each SKU: Declaration of Conformity, test reports, risk assessment, production quality control procedures, and traceability records. All files formatted for EU customs inspection requirements.

Results

  • 23/23 SKUs achieved full EN 71 compliance
  • CE marking applied correctly with proper Notified Body reference
  • Amazon EU listings restored within 2 weeks of documentation upload
  • Zero recalls in 12 months post-launch across DE/FR/UK markets
  • Template established — new SKUs now follow the same compliance pathway automatically

Key Takeaway

EU toy safety compliance is complex but navigable with the right factory-level coordination. The critical success factor was having an on-the-ground team who could work directly with Chinese factories on material substitutions and testing logistics — something that's nearly impossible to manage remotely from the US.
